General Terms and Conditions

1. Scope These General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is directed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a legally capable partnership that acts in the course of its commercial or independent professional activity when concluding a legal transaction.

1. Contract Partner, Conclusion of Contract, Correction Options The purchase contract is concluded with Avapari GmbH.

By listing products in the online shop, we make a binding offer for the conclusion of a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained during the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

1. Language of the Contract, Storage of Contract Text The available language(s) for concluding the contract: German.

We will store the contract text and send you the order details and our GTC in text form. You can view the contract text in our customer login.

1. Subject Matter of the Contract 4.1 Product Description The applicability of the respective product description as an essential part of the contract is emphasized.

Due to individual screen configurations (e.g., resolution and brightness), slight deviations between the displayed and actual product colors may occur.

1. Delivery Conditions 5.1 Shipping Costs In addition to the stated product prices, shipping costs may apply for standard shipping. More details regarding the shipping costs can be found in the offers.

5.2 Delivery Options We ship the products to the delivery address specified during the ordering process.

We only deliver via shipping. Unfortunately, self-collection of the goods is not possible.

1. Payment 6.1 Prices The prices stated at the time of the order apply. These are total prices and include the statutory value-added tax.

6.2 Payment Methods The following payment methods are generally available in our shop:

• Credit Card
  During the ordering process, you enter your credit card details. Your card will be charged immediately after placing the order.

• Amazon Pay
  To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate with your login details, and confirm the payment order. The payment transaction will be processed by Amazon Pay within one business day after placing the order.

• Apple Pay
  To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have the Apple Pay function activated, authenticate with your login details, and confirm the payment order. The payment transaction will be processed immediately after placing the order.

• BillPay
  In cooperation with the payment service provider "BillPay," operated by Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment via BillPay requires a successful address and credit check and is made directly to BillPay.

• Invoice via BillPay
  The invoice amount is due after shipping the goods and receipt of the invoice.

• giropay
  In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer giropay as a payment option. To pay the invoice amount via giropay, you must have a bank account enabled for online banking, authenticate accordingly, and confirm the payment order. Your account will be charged immediately after placing the order.

• Google Pay
  To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have the Google Pay function activated, authenticate with your login details, and confirm the payment order. The payment transaction will be processed immediately after placing the order.

• Klarna
  In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options. Payment via Klarna is only available for consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna.

• Purchase on Invoice via Klarna
  The invoice amount is due 30 days after shipping the goods and receipt of the invoice.

• Klarna Credit Card
  During the ordering process, you enter your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check is conducted.

• Klarna Direct Debit
  You authorize Klarna with a SEPA direct debit mandate. Klarna will inform you about the date of the account debit (so-called prenotification). The account will be debited after shipping the goods.

• Installment Purchase via Klarna
  You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment amount is €6.95.

• paydirekt
  In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M, we offer paydirekt as a payment option. To pay the invoice amount via paydirekt, you must have a bank account enabled for online banking, authenticate accordingly, and confirm the payment order. The payment transaction will be processed immediately after placing the order.

• PayPal, PayPal Express
  To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your login details, and confirm the payment order. The payment transaction will be processed by PayPal immediately after placing the order.

1. Retention of Title The product remains our property until full payment has been made.

2. Transport Damages If goods are delivered with obvious transport damages, please report such errors as soon as possible to the delivery person and contact us immediately. The failure to make a complaint or contact us has no consequences for your statutory rights and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

3. Warranty and Guarantees 9.1 Statutory Warranty Rights The statutory warranty rights apply.

9.2 Guarantees and Customer Service Information regarding any applicable additional guarantees and their exact conditions can be found with each product and on specific information pages in the online shop.

1. Dispute Resolution The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

Should individual clauses of these GTC be wholly or partially ineffective, the contract remains effective in all other respects. To the extent that individual clauses are ineffective, the content of the contract is governed by the statutory provisions.
